BOOKGENA MEMBERSHIP AGREEMENT

Terms of Use

These Terms of Use set out the rules for using the BookGena website and installable web application. The service is owned and operated by Can Kırkgöz. By creating an account, a user reads and accepts this text and becomes a party to the agreement.

1. Scope of the service

BookGena offers reading of books and screenplays, storage of reading progress, comments, likes, bookmarks, highlights and optional new-chapter notifications. An account is not required to read; it is required for community features and for syncing across devices.

2. Accounts and age requirement

You must be at least 13 years old to create an account. Users are responsible for the accuracy of the information they provide and for the security of their account and password. If you suspect unauthorised use, contact BookGena without delay.

3. Intellectual property

The book texts, covers, characters, marks, designs and other works on BookGena belong to their respective rights holders. The content may be used only for personal, non-commercial reading. Copying, reproducing, assembling a work from screenshots, distributing, republishing, selling, or using the content to train artificial intelligence systems without permission is prohibited.

4. User content

Users confirm that the comments they post are lawful and that they hold the necessary rights. Posts containing insults, threats, harassment, hate speech, disclosure of personal data, spam or copyright infringement may be removed. Users grant BookGena a non-exclusive, royalty-free licence, limited to the duration of the service, to display and technically process their comments.

5. Service changes and account actions

The service may change for reasons of security, maintenance, legislation or product development. Accounts that breach these terms, endanger the security of the service or infringe the rights of others may be suspended. Users may request deletion of their reading data from the account page.

6. Limitation of liability

The service is provided with reasonable care; uninterrupted or error-free operation is not guaranteed. Rights arising from mandatory consumer legislation are reserved. To the extent permitted by law, BookGena is not liable for indirect damages it did not directly cause through its own fault.

7. Governing law

This agreement is governed by the laws of the Republic of Türkiye. Mandatory jurisdiction rules are reserved, including a consumer’s right to apply to the competent authorities in their place of residence.

Personal Data Protection Notice

The data controller for your personal data is Can Kırkgöz. For questions and for requests under Turkish Personal Data Protection Law no. 6698, please write to [email protected].

1. Data processed

• Identity and account: email address, display name, account identifier and password verification records.
• Profile: year of birth derived from your age, and an optional gender preference.
• Usage: reading progress, bookmarks, highlights, likes and notification preferences.
• Content: comments, replies and the related moderation records.
• Security and technical records: session, timestamp, error and limited technical data used to prevent abuse.
• Agreement record: the version of the terms and notice accepted, and the date of acceptance.

2. Purposes and legal grounds

Data is processed to create and manage your account, sync your reading records, provide comment and like features, maintain security, meet legal obligations and establish, exercise or protect legal rights. Processing relies on the grounds in article 5/2 of Law no. 6698: performance of a contract, legal obligation, establishment of a right, and legitimate interest. New-chapter emails are sent only if the reader separately asks for them from inside the book, and that preference can be withdrawn at any time.

3. Collection method and recipients

Data is collected electronically through registration and interaction forms, reading actions, session cookies and technical security records. To deliver the service it may be shared, only as far as necessary, with Neon (authentication and database), OpenAI Sites and Cloudflare (hosting and security), and — only when notifications are requested — Brevo (email delivery). Transfers to public authorities are made only where legally required.

4. International transfers

Because the infrastructure of technical service providers may sit outside Türkiye, limited data may be processed abroad. Such transfers rely on the appropriate safeguards set out in article 9 of Law no. 6698 or on other lawful transfer mechanisms.

5. Your rights

Under article 11 of Law no. 6698 you have the right to learn whether your data is processed, to request information about it, to learn whether it is used for its stated purpose, to know the third parties it is transferred to, to have incomplete or incorrect data corrected and — where the conditions are met — erased, to object to a result reached solely by automated processing that works against you, and to claim compensation for damage caused by unlawful processing.

Privacy, Cookies and Retention

Strictly necessary session cookies keep you signed in and protect security. Local storage may hold device preferences such as theme, font size and reading progress for readers without an account. No non-essential advertising or behavioural tracking cookies are used.

Account and profile data is kept while the account is active; agreement and security records are kept only for the periods dictated by legal disputes and statutes of limitation. When an account is deleted, reading progress, highlights and bookmarks are deleted. Comment text may be anonymised by removing its link to the account, so that conversations remain readable.

If the terms change materially, the new version date is published on this page and, where necessary, acceptance is requested again.
